At a time when Telangana government is going ahead in full steam acquiring land from farmers across the state for various projects quoting GO123; High Court quashed the GO as unconstitutional and ultra vires to a central act. According to the said GO it is for the farmer to willingly come forward voluntarily to give away his land to the government. But apparently they were coerced into giving away their lands, and some are putting up a fight, but owing to disparity in the power vis a vis the government they are eventually giving in to the pressure. And the GO is being used to deny benefits to the farmers.
However the GO had to be passed as per the central act according to which (Section 107 – Right to Fair Compensation and Transparency in Land Acquisition, Rehabiliotation and Resettlement Act).
High Court said that Telangana governmentis acting like a property dealer in reply to a petition by Algi Thukamma and 22 other landless agricultural labourers of Medak district.
It is a major setback for Telangana government with regard to many of its projects, and a shot in the arm for the warring farmers at Mallannasagar. Irrigation Minister T Harish Rao said that the State government will study the court order, and of need be will move the division bench challenging the single bench judge order.
